Privacy Policy
We know that your privacy is important to you, and we work hard to earn and keep your trust. We have created this Privacy Policy (“Policy”) to let you know what information we collect when you use our website (“Site”) which is owned and operated by SimpleVMS (“we,” “us,” “our” or “SimpleVMS”) and the related applications, services, and products offered by the Company (“App”) (collectively, the ”Services”) and how we use and share the information we collect.
Your Consent
Please review this Policy before using the Services. By using the Services, you are consenting to the collection, use, and disclosure of your information as set forth in this Policy. If you do not agree to be bound by this Policy, you may not access or use the Services. Some services are dependent on your Biometric Data (as defined below). SimpleVMS’s policy with regard to Biometric Data is available here. The terms in the Biometric Policy apply specifically to Biometric Data: they supplement, and to the extent, there is any conflict, supersede the terms of the Privacy Policy with respect to Biometric Data and the protections afforded to Biometric data and restrictions imposed on the use of Biometric Data.
Types of Information We Collect
Information You Volunteer. SimpleVMS collects the Personal Information you knowingly and voluntarily provide when you use the Services. “Personal Information” includes but is not limited to name, email address, company name, address, and for some services Biometric Data. We collect the Personal Information you provide when you download and use our App, login to our Site, use our Services, or contact us with questions.
Biometric Data means a repeatable measurement of a person’s physical, biological, or behavioral traits, characteristics, or measurements of or relating to an identified or identifiable person’s body and the data derived therefrom where such measurements and data are used to identify an individual.
Information Others Volunteer. Users may invite you to the Services or initiate the signup process on your behalf. These users may provide us information about you, such as your name and email address.
Information Automatically Collected. We may automatically collect information about the devices and functionalities which you are controlling using the App (which may also identify your location).
Web Browser Information. We collect information that is sent to us automatically by your Web browser. This information typically includes your IP address, the identity of your Internet service provider, the name and version of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. Please check your browser if you want to learn what information your browser sends or how to change your settings.
More About IP Addresses. An “IP address” is a unique number that is automatically assigned to your computer when you connect to the Internet. It is used to identify your computer’s “location” in cyberspace so that the information you request can be delivered to you. If you use a dial-up connection or a connection that assigns dynamic IP addresses, your computer will be assigned a new IP address each time you connect to the Internet. However, if your computer is permanently connected to the Internet using a static IP address, the IP address assigned to your computer will generally be the same each time you use your computer.
We may link your IP address to account information that identifies you personally. We may also provide your IP address to our third-party service providers who can use it to identify your state and zip code. This gives us valuable demographic information about the individuals who use the Services. In addition, if we suspect inappropriate or criminal activity or a threat to the security of the Services, we may share our server logs—which contain users’ IP addresses—with the appropriate investigative authorities, who could use that information to trace and identify individuals.
Cookies and Similar Technologies. We use “cookies” and other web technologies to collect information and support certain features of the Services. For example, we may use these technologies to:
- collect information about the ways visitors use the Services—which pages they visit, which links they use, and how long they stay on each page
- support the features and functionality of the Services—for example, to save you the trouble of reentering information already in our database or to prompt the settings you established on previous visits
- personalize your experience when you use the Services
- to understand specific information related to the products you connect to the Services
Generally, if you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer. Although you are not required to accept cookies when you visit the Services, you may be unable to use all of the Services’ functionality if your browser rejects our cookies.
Third-Party Cookies
In addition to the cookies SimpleVMS delivers to your computer through the Services, certain third parties may deliver cookies to your computer for a variety of reasons. For example, we use Google Analytics, a Web analytics tool that helps us understand how visitors engage with the Services. Likewise, marketing or advertising companies may deliver cookies through the Services or via e-mail that allow them to recognize you in future web sessions as someone who has expressed an interest in the Services or in our products or services.
SimpleVMS does not have access to, nor control over, the cookies of third-party service providers or advertisers. However, you have choices about the collection of information by third parties on the Services. For example, if you don’t want information about your visit to the Services sent to Google Analytics, you may download an Opt-out Browser Add-on by tools.google.com/dlpage/gaoptout. Please note that the Add-on does not prevent information from being sent to SimpleVMS. You may set your browser to reject cookies or to alert you when a cookie is placed on your computer. Please note, however, that your browser settings may not allow you to control delivery of cookies via e-mail.
How We Use Information Collected Through the Services
Generally, we use the information we collect through the Services:
- to provide the information, products and services you request or that might be of interest to you
- to suggest content that might be relevant to you
- for our marketing purposes
- for security, credit, or fraud prevention purposes
- to provide you with effective customer service
- to provide you with a personalized experience when you use our Sites
- to contact you with special offers and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us)
- to contact you with information and notices related to your use of our Sites
- to invite you to participate in surveys and provide feedback to us (in accordance with any privacy preferences you have expressed to us)

- to improve the content, functionality, and usability of the Services

- for any other purpose identified in an applicable privacy notice, click-through agreement, or other agreement between you and us
- to understand specific information related to the products you connect to the Services

Information Disclosures
By using the Services, you are permitting us to disclose your information to others. We disclose your information to the following parties: business partners; our service providers; and other parties that may provide services to you.
Your Choices
In General. We respect your right to make choices about the ways we collect, use, and disclose your Personal Information. Discussed above are choices you have about delivery of cookies to your computer through the Services. In addition, we generally will ask you to indicate your choices at the time we collect your Personal Information. For example, we provide you with an opportunity to “opt out” off receiving certain communications from us. In addition, we will include an “unsubscribe” link in each electronic newsletter or promotional e-mail we send you, so that you can inform us that you do not wish to receive such communications from us in the future.
Previously Expressed Preferences. If at any time you wish to be taken off our mailing lists, please contact us using the information provided below. Once we have the information we need, we will remove you from our mailing lists as you have requested. Please give us a reasonable amount of time to honor your request.
How to Access, Update or Correct Your Personal Information
If you are a registered member of the Services, you may be able to access, update, or correct your Information through your account settings. Otherwise, you may need our help. If you wish to access, update, or correct your Information, please contact us using the information provided below. We will respond to you promptly, generally within 72 hours and, in any case, within the time limits established by applicable law. We may ask you for additional information to verify your identity. In most cases, we will provide access and correct or delete any inaccurate information you discover. In some cases, however, we may limit or deny your request if the law permits or requires us to do so or if we are unable to verify your identity. We may delay deleting your information until business transactions underway are completed. Deleting your information may terminate any services you have been receiving through SimpleVMS.
Access to your data is free of charge. If requested, your data will be provided via secure email in a text format, readable with the free text editor provided with any Apple, Android, Linux, Unix or Windows operating systems.
Steps We Take to Safeguard Your Personal Information
We maintain reasonable administrative, physical, and technological measures to protect the confidentiality and security of information you submit on or through the Services in accordance with applicable standards and laws. Unfortunately, no website, app, server or database is completely secure or “hacker proof.” We therefore cannot guarantee that your Personal Information will not be disclosed, misused, or lost by accident or by the unauthorized acts of others.
How We Share Your Information with Others
Third-Party Vendors. SimpleVMS shares information collected through the Services with third-party vendors who act for or on behalf of SimpleVMS. These third-party vendors may need information about you to perform their functions.
Other Users of the Site. Your information may be shared with other users of the Services, depending on your classification. If you are invited to the Services by someone else, they may be able to see the content you post on the Services.
Business Negotiations. We may contemplate, for strategic or other reasons, selling, buying, merging, or otherwise reorganizing one or more of our businesses. In negotiating with a third party about entering into such an arrangement, we may need to disclose your information. In such cases, we will take reasonable measures to protect the information we disclose, for example, by requiring a prospective purchaser to sign a non-disclosure agreement limiting the use and protecting the confidentiality of the information.
Business Transfers. Your information may be transferred to a successor organization if, for example, we transfer the ownership or operation of the Services to another organization or if we merge with another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Policy and the privacy preferences you have expressed to us.
Compliance with Laws and Protection of Our Rights and the Rights of Others. We may disclose your Personal Information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose your information to prevent or investigate a possible crime, such as fraud or identity theft, to protect the security of the Services, to enforce or apply our agreements, or to protect our own rights or property or the rights, property, or safety of our users or others.
As Described in a Privacy Notice. We reserve the right to disclose your information as described in any other document posted on a page of the Services where you provide that information. By providing your information on that page you will be consenting to the disclosure of your information as described in that privacy notice.
As Described in a Click–Through Agreement. We reserve the right to disclose your information as described in any click–through agreement to which you have agreed.
Children Under the Age of Eighteen
We are proud of the Services and we strive to ensure that it does not offend people of any age. However, the Services are not intended for children or minors under the age of eighteen years without the permission of a parent or guardian. If you believe that a child has submitted information on or through the Services without the consent and supervision of a parent or guardian, please contact us using the information provided below so that we can take appropriate action.
Links to Other Sites
The Services may contain links to Websites operated by other organizations, including Websites operated by our third-party service providers and other third parties. For example, if you click on an advertisement on the Services, you may be taken to a Website that we do not control.
This Policy does not apply to information collected on any third-party Website. When you access third-party Websites through a link on the Services, please take a few minutes to review the privacy policy posted on that site.
Location Services
Our apps use location services for the following:
- Location based job searches
- Auto-filling addresses
- Calculating travel time to job location
- Clocking-in and clocking-out on jobs that require GPS data
Definitions and Important Information
When you enter Personal Information into any of SimpleVMS’s services you are, in legal terminology, a “data subject” and have the right to request changes to your data as described in this policy.
In most cases SimpleVMS is processing your data on behalf of a staffing organization with which you have a direct relationship. In that case the staffing organization is the “Data Controller” and has the authority to make the changes you may request. SimpleVMS is the “Data Processor” for that organization. SimpleVMS will support the Data Controller in processing your request but cannot make any changes without the Data Controller’s approval.
If you have provided information directly to SimpleVMS, perhaps in the process of evaluating our services or working for a staffing organization, then SimpleVMS is most likely the controller of your data and can be contacted as described below.
Legal Compliance
SimpleVMS complies with all applicable laws, including (without limitation) the California Consumer Privacy Act (CCPA), the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Law(CUBI), and Washington’s biometric privacy Laws. This document describes SimpleVMS’s data privacy practices. Under the CCPA and other legislation and regulations you have the right to:
- Know about the personal and biometric information we collect about you, as described in detail previously in the section “Types of Information We Collect”;
- The right to delete or correct personal and biometric information we have collected about you, as described above in the section “How to Access, Update or Correct Your Personal Information”;
- The right to opt out of sharing of your personal and biometric information. SimpleVMS does not sell personal or biometric information and only shares information with partners who provide essential functionality to our Services;
- The right to non-discrimination for exercising your CCPA rights; and
- The right to limit use of your personal and biometric information. SimpleVMS uses your information to provide the Services offered by our Company and limiting the use of your data may result in your inability to receive some Services.
SimpleVMS is not obligated to provide a request for personal information to the same consumer more than twice in a 12-month period. Information requested to be delivered within a 45 day delivery period, will include personal information collected within the 12 month period preceding the receipt of the consumers request and is deliverable either by the consumers business account, if one exists, mail or electronically at the consumers option, and will be in a readily usable format that allows the consumer to transmit the information without hindrance.
Personal information does not need to be retained, for a single one-time transaction, if in the normal course of business the transactional information does not reidentify or link any of the data in a manner that would be considered personal information.
A process is in place to disclose to the consumer the category or categories of personal information that could potentially or has been sold or disclosed.

This Policy May Change
This Policy describes SimpleVMS’ current policies and practices with regard to the information we collect through the Services.
We are continually improving and adding to the features and functionality of the Services and the services we offer through the Services. As a result of these changes (or changes in the law), we may need to update or revise this Policy. Accordingly, we reserve the right to update or modify this Policy at any time, without prior notice, by posting the revised version of this Policy behind the link marked “Privacy Policy” at the bottom of each page of the Services. Your continued use of the Services after we have posted the revised Policy constitutes your agreement to be bound by the revised Policy.
In the event we change this Policy, we will update the “last updated” date at the top of this page. Please be sure you check that date to see if this Policy has been revised since your last visit.
